It is a reality that in today’s times, it is important to consider entering into an Ante Nuptial Contract prior to walking down the aisle. At Cari du Toit Attorneys, we come to you. Marriage in Community of Property: All assets brought into the marriage, are owned jointly by both spouses and are shared by both spouses equally until death or divorce. Marriage out of Community of Property (with the application of the Accrual System): An Ante Nuptial Contract has to be entered into, before the date of the marriage. Both spouses retain ownership of all of their assets brought into their marriage. “with Accrual” means that both spouses enter into the marriage with a “start up value” and can also specifically exclude assets. Which will not be shared with their spouse. At the end of the marriage, either upon death or divorce, the parties will effectively split (equally) between them any increase in their combined estates. Marriage out of Community of Property (without the application of the Accrual System): A straight ANC implies that each of you starts with and keeps a separate estate from your significant other. What accrues to either estate during the marriage remains in that estate, and neither spouse benefits from a loss or increase in the estate of the other spouse. Thereafter, we will prepare the Ante Nuptial Contract, to be forwarded to both you and your spouse to be, for any questions or comments that you may have. Once the document has been finalised, we will again meet with you on an after hours basis, for the document to be signed, which will thereafter be given to our Notary who will attend to register it at the Deeds Office.
